1. Introduction

Welcome to SamajHub. These Terms of Service ("Terms") govern your access to and use of the SamajHub website, mobile applications, platform, APIs, and any other related services (collectively, the "Service"). By creating an account or accessing the Service, you signify your agreement to these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility and Account Registration

To use SamajHub, you must be at least 18 years old or the legal age of majority in your jurisdiction. By registering, you represent and warrant that the information you provide is accurate, complete, and current at all times.

• Account Security: You are responsible for safeguarding your password and credentials. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
• Samaj Admin Roles: Users designated as "Admins" for a specific family or Samaj unit bear the responsibility of moderating their community, assigning appropriate access roles, and managing subscription billing.

3. Acceptable Use and Community Guidelines

SamajHub is built to foster positive community and family relationships. We enforce a strict zero-tolerance policy for abuse. When using the Service, you agree not to:

• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Attempt to gain unauthorized access to the Service, other user accounts, or the computer systems or networks connected to the Service.
• Use the platform for spamming, phishing, or distributing unsolicited promotional materials.

4. User Generated Content & Intellectual Property

Our Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("Content").

Your Ownership: You retain all your rights to any Content you submit, post, or display on or through the Service. By submitting Content, you grant SamajHub a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, and display such Content strictly for the purpose of providing and operating the Service.

SamajHub Property: The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of SamajHub and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

5. Subscriptions, Billing, and Refunds

Certain aspects of the Service are billed on a subscription basis ("Subscriptions"). You will be billed in advance on a recurring and periodic basis (such as monthly or annually), depending on the type of subscription plan you select when purchasing.

• Free Trials: We may offer a Subscription with a free trial for a limited period of time. You may be required to enter your billing information to sign up for the Free Trial. You will not be charged until the Free Trial has expired.
• Fee Changes: SamajHub, in its sole discretion and at any time, may modify the Subscription fees. Any Subscription fee change will become effective at the end of the then-current Billing Cycle. We will provide you with reasonable prior notice of any change.
• Refunds: Except when required by law, paid Subscription fees are non-refundable. Certain refund requests may be considered by SamajHub on a case-by-case basis and granted at our sole discretion.

6. Third-Party Links and Integrations

Our Service may contain links to third-party web sites or services (such as payment gateways like Razorpay or authentication providers) that are not owned or controlled by SamajHub. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that SamajHub shall not be responsible or liable, directly or indirectly, for any damage or loss caused by your use of such third-party services.

7. Termination of Service

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact your Samaj Admin to delete your profile.

8. Limitation of Liability and Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. SamajHub expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall SamajHub, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; and (iii) unauthorized access, use or alteration of your transmissions or content.

9. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Gujarat, India.

10. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
